According to Section 84 of Act No. 251/2012 On Energy, as amended (hereinafter referred to as the Act on Energy), TRANSPETROL a. s. is obliged, among other things, to ensure reliable, safe and efficient operation of the pipeline and related networks.

According to Section 86 of the Energy Act, the pipeline is protected throughout its length by a protection zone defined by vertical surfaces running at a horizontal distance of 300 m on both sides of the pipeline and serves to ensure the smooth operation of the pipeline and to ensure the safety of persons and property, while the owners and users of real estate in the protection zone are obliged to refrain from anything that could damage the pipeline and endanger the continuity and safety of operation.

The restrictions in the protection zone of the pipeline are regulated in Section 87 of the Energy Act as follows:

(1)' In the protection zone of the pipeline, it is prohibited to establish objects of particular importance, towing pits of exploration and production undertakings and roll-outs.'

(2) 'In the protection zone of the pipeline, except in the protection zone of the oil pipeline from the place of extraction to the processing site, it is prohibited to

(a) build bridges and waterworks on the watercourse 200 m from the centre line of the pipe;

(b) 150 m from the axis of the pipe along the pipeline to continuously stop the land, build other important buildings and build railway lines;

c) 100 m from the axis of the pipe to build any structures,

d) 50 m from the axis of the pipe to build a sewerage network,

(e) build a pipe for the transport of substances other than class I and Class II flammable substances from the centreline of the pipe;

(f) carry out activities 10 m from the centreline of the pipe, in particular excavations, probes, clearing and toping of soil and planting of trees which could endanger the safety of the pipe and the continuity of operation.'

(3) 'The construction works and the maintenance work on the construction site in the protection zone of the pipeline may be established only with the prior consent of the pipeline operator and the owner of the land on which the building is or is to be built. The consent of the pipeline operator and the owner of the land on which the building is or is to be built for the establishment of the building in the protection zone of the pipeline is a document for zoning and construction proceedings; other activities referred to in paragraph 2 in the protection zone of the pipe may be carried out by persons only with the consent of the pipeline operator and under conditions specified by the pipeline operator, including appropriate conditions to ensure the safety of the pipe.'

Violation of the protection zone of the pipeline can cause damage not only to the pipeline, but also to damage to the life and health of persons, property, environment, etc.!
